TODAY IN PHILIPPINE HISTORY:
Benigno Aquino III, the newly inaugurated President, signed Executive Order No. 1 creating the Truth Commission. The Commission was to investigate alleged anomalies in the past nine years of the previous administration of former President Gloria Arroyo. It was to be headed by former Chief Justice Hilario Davide.
The Truth Commission would have coercive powers and could subpoena witnesses and take their testimonies and administer oath. However, on July 26, 2011, the Philippine Supreme Court ruled with finality that Aquino’s Executive Order 1 creating the Philippine Truth Commission was unconstitutional.
The Supreme Court noted that the Truth Commission “violates the equal protection clause of the 1987 Constitution” by focusing on one administration.
